The USPTO has evaluated the effect of any such rule on the economy, the integrity of the patent system, the efficient administration of the USPTO, and the ability of the USPTO to timely conclude proceedings initiated under 35 USC 316(b). The ANPRM contains ideas.
The USPTO is seeking feedback on various proposals relating to the rules that the Director, and by delegation, the PTAB will use in exercising discretion to initiate inter partes and post-grant reviews under 35 U.S.C. 314(a), 324(a), and 325(d). The USPTO is also seeking feedback on ideas that would allow petitioners to pay additional fees for petition word limits, establish a separate information process for optional ground arguments, and require parties who settle before an institution to file copies of any settlement agreements with the PTAB.
This ANPRM provides an opportunity for inventors, investors, and stakeholders to submit comments on the proposed changes that the USPTO will make, as well as any changes that the USPTO will not proceed with.
