ANPD: understand the importance of the agency for LGPD

Over the past year, digital crimes have increased globally. According to a survey conducted by Kaspersky, an information security company, on the practice of phishing — a term used to define the theft of personal or financial data on the internet — Brazil was the country with the highest number of cybercrime victims: between February and March 2020, attacks increased by 120%. Brazilian legislation has made significant progress in addressing data privacy issues. Although privacy protection is guaranteed by the 1988 Federal Constitution, it was with the Consumer Protection Code in the 1990s that the first rules on the processing of personal data began to emerge. More recently, the Access to Information Law (LAI) and the Internet Civil Rights Framework , from 2011 and 2014, respectively, represented important milestones for the privacy of personal data.


With regulations aimed at telephone operators, through the National Communications Agency (Anatel) , Brazilian standards have evolved to encompass digital evolution and the consequent needs for oversight. With this, inspired by the General Data Protection Regulation (GDPR), published by the European Union, Brazil sanctioned the General Data Protection Law (LGPD) in 2018, after 10 years of processing.


The LGPD , which came into force last year, consists of 65 articles that seek to regulate the processing of data by companies and public bodies. It applies to organizations operating in Brazil, but may be extended to other nations if the information is stored in foreign countries.
