Threatens the competitive advantage that European tech companies enjoy over their US counterparts by undermining the protections we can offer our customers. It breaks the long-standing rule that only trusted national authorities can order companies to hand over customer data for criminal investigations.
In contrast, the Commission’s e-Evidence proposal would allow any foreign EU authority to compel us to hand over our customers’ data, without our own authorities corroborating the foreign order. Unlike American Big Tech companies, European privacy tech companies lack the resources to verify the legality of each and every foreign order. Because of the list of argentina whatsapp phone numbers way the e-Evidence proposal is worded, we would not even be able to authenticate the legitimacy of foreign authorities to ensure that we are not responding to a malicious actor, let alone object to an order if we found it was not justified.
HOW TO SOLVE IT
The spokesperson's draft report contains a number of substantial improvements that deserve support:
Suggests involving national judicial authorities whenever requests for data from foreigners occur (amendments 127, 141, 142, 161);
This corrects the Commission's failed attempt to define functional data categories (Amendments 90-97);
And it allows online service providers, such as us, to inform our customers about external data requests that take place, provided that this does not constitute an obstruction to ongoing investigations (Amendments 163 and 164).
